An excellent series of arguments against "qualified immunity!"

There is a lot of negative stuff being repeated incessantly by our increasingly obtuse media AND there are also silver linings hiding in the weeds, which makes them very hard to see unless one is looking or soomeone else is looking out.

Bravo Judge Carlton Reeves! Bravo indeed!

Thank you Judd Legum. Good looking out!

Thank you, Judd, for sharing your legal knowledge and wisdom. For us to argue we must learn more about these facts around "qualified immunity," this shield to protect racist law enforcement officers from punishment for killing black citizens for no cause. What should be a crime has ignored the KKK Act enacted by Congress to address this grievous wrong--so now we're dependent on the SCOTUS to eliminate the bogus "qualified Immunity"?

Before seeing your column today, I came upon Parker Molloy's substack piece yesterday on Greg Abbott's misuse of this same law in TX (referrring to Philadelphia Inquirer article). “Scared about America losing democracy? Texas is already gone” (The Philadelphia Inquirer, Will Bunch, 5/19/24)

It must be time for serious national action on this issue. Lead the way, Judd!

Thank you Valerie, living in Texas I can attest to the fact that Will Bunch is absolutely right...Texas IS already gone. And it isn't just Abbott who has created a lawless state...our illustrious AG Ken Paxton has done his part, including breaking numerous laws himself.

I hope that there is hope for a more humane Texas...if Colin Allred can become the next Senator, and if maybe Jessica Cisneros can replace Henry Cuellar, and assume her rightful place in the House. I still do not understand why Nancy Pelosi (and Stenny Hoyer and Hakeem Jeffries) favored Cuellar--do you? Was it about the anti abortion vote?

Good question Valerie. I think it could be because he is a 'caucus colleague', voting their way, someone whom they felt a loyalty to and also a lack of awareness of Texas politics. Just a guess. I agree about Allred and Cisneros being good for our state. They have my support.

Ken Paxton is as corrupt, corruptible and corrupting as any XtreMe RW'r you've ever seen and known.

It's absolutely astounding how this monster thumbs his nose at everything that it means to be moral, a man in spirit not just in species, a leader by example over proclamation.

Sweet crispy Jesus that man has EARNED a good legal, moral and physical beat-down just to even the scales a bit.

Can't agree more...Paxton is in the same vein as all trumpican-maga politicians. Corrupt, liar, cowardly and unaccountable for anything and everything. Name one who isn't.

Yes, yes, yes goddammit YES!!!

The mechanism by which "some" folken can perform the necessary mental gymnastics to actually form their mouths into a tubes that spew stupid shite like "both side are the same" or "the Biden Crime Family" while not acknowledging or even NOTICING "the Trump Crime Family's" obvious and absolute corruption completely eludes me.

Thank you for this article. I have followed qualified immunity for LE for sometime. A check for a win here. Our judicial system is full of judges higher up the rung including on SCOTUS, that could flip this ruling and of course police organizations that support qualified immunity 100% will likely supply money for a challenge.

But right now I savor this win. Thank you so much for writing about it.

“But Reeves argues that the Supreme Court's decision in Dobbs, upending "50 years of precedent" and eliminating "the Constitutional right to a pre-viability abortion," negates this concern.”

Poetic justice how sweet the sound.

The law enforcement officers committing these acts don’t know about “qualified immunity” but their benevolent associations fucking damn well do.

Yep, I love the way the judge turned the tables and used the Dobbs decision as a basis for eliminating “qualified immunity”

This seems like a big win for holding law enforcement accountable. Thanks for the good news/lesson on qualified immunity.

Thank you for tireless pursuit of growing injustices. Just wish the money had not corrupted our corporate media. This judge needs a spotlight. But then he would become a target for the haters….

Yes! His honor is a national treasure!

It was interesting how the calls of "he should have listened" were muted with the arrest of Scottie Scheffler last week to "it was an misunderstanding." Qualified immunity was essentially put in place to appease people who wanted to oppose the 'Civil Rights Act.'

That is a very cogent observation Mike.We are all in your debt. Thankyou.

Wow. Thank you for covering this important case. Yes, if legislatures want qualified immunity protections then they can pass laws that do that. Look forward to reading the decision itself. Perhaps this will be the career-defining legacy of Judge Carlton Reeves.

More laws to give cops license to murder civilians without consequences- sounds like what Congress is excited to pass - and they haven’t even heard it yet!

As usual, Judd, this is a profoundly important story addressing the government claim to immunity. until the state is as liable as the individual for its actions, justice can only be a theory.

I’m feeling very happy to hear about this case and how it was argued BEFORE the Roberts court rules on the question of Presidential immunity in Trump’s case.

Thank you for reporting one of the most important cases. The MSM is too busy with drumfp show to be bothered to inform public of consequential events happening around the country. Though they'll wake up from drumfp trance to pick it up, now that Judd has reported it.
